Termination Process

Belarusian employers are required to provide reasons for termination to employees which can include the employee's behavior at work, business-related economic reasons, and/or the employee's ability to perform duties at work effectively.

Additional termination clauses must be included in the contract between the employee and the employer. The contract must include clauses addressing the following scenarios, as well as what happens when the contract's term expires.

Termination types:

  • By mutual consent
  • The term of the fixed-term contract naturally expires.
  • The employee agrees to be transferred to a new and different position.
  • The employee is opposed to relocating to a new workplace.
  • The employee is dissatisfied with the company's new labor conditions or reorganization (often relevant in the event of an acquisition)

If an employer terminates an employment contract after a probationary period, the employer must provide a valid and just reason. Unless otherwise specified in an agreement, the notice period must be at least two months.

Notice period

Employers in Belarus must provide at least one month's notice. Three months is the maximum notice period that can be established.

Probation Period

The maximum probation period in Belarus is three months. A minimum of three days' notice is required for early termination during the probationary period.

Severance Details

The details of severance pay are usually specified in the employment contract. In most cases, a default minimum of two weeks of the employee's average salary is used.
